Spain's Startup Visa, formally known as the Visa de Emprendedor, provides a streamlined residency pathway for non-EU entrepreneurs seeking to establish innovative businesses in Spain. The program was significantly enhanced under Law 28/2022, the Ley de Fomento del Ecosistema de Empresas Emergentes, which came into force in late 2022 to boost Spain's startup ecosystem and attract international talent. Applicants must obtain certification from ENISA (Spain's National Innovation Company) confirming their business plan meets innovation and viability standards, with the law including positive administrative silence provisions that grant automatic approval if ENISA does not respond within three months.

To qualify for the program, entrepreneurs must demonstrate a viable business project that develops or improves products, services, or processes through innovation or technology. The company must be less than five years old, or seven years for biotechnology, energy, or strategic industrial sectors, with annual revenue not exceeding EUR 10.0M . Financial requirements include maintaining funds equivalent to 100% of Spain's IPREM (approximately EUR 7K annually), plus additional amounts for family members. While the official requirement is based on IPREM, many Spanish consulates expect higher proof of funds, sometimes requiring EUR 32K for the main applicant, reflecting local interpretations of adequate financial means.

The ENISA evaluation process typically takes between one to three months, with the complete visa approval process requiring approximately four months from initial business plan submission to receiving the residence authorization. Once approved, entrepreneurs receive an initial residence permit valid for one year, renewable for two-year periods thereafter. After five years of continuous legal residence, entrepreneurs become eligible for permanent residency, and after ten years they may apply for Spanish citizenship. The permit provides immediate access to all 26 Schengen countries, and family members including spouse, dependent children under 18, and economically dependent parents may be included in the application.

Spain's Startup Law offers substantial tax benefits for certified startups, including a reduced corporate tax rate of 15% instead of the standard 25% during the first four profitable fiscal years. Additionally, startups can defer tax payments for the first two profitable years without interest or guarantees. Entrepreneurs relocating to Spain may opt for non-resident taxation (IRNR) at 24% on income up to EUR 600K , provided they have not been tax residents in Spain during the previous five years.

Spanish language proficiency is required for permanent residency and citizenship applications, along with passing a constitutional and sociocultural knowledge test (CCSE) and a Spanish language exam (DELE A2 or higher).
